INSS e eSocial não se comunicam e empregados ficam sem benefícios

Em janeiro, o Jornal Nacional mostrou a dificuldade que os empregados domésticos enfrentavam quando tentavam receber benefícios, como auxílio-doença. Quase dois meses depois, nossos repórteres foram ver se a situação mudou.

Luciana todo mês entra no e-social para pagar as obrigações trabalhistas e previdenciárias da Ana, que é babá. Esse sistema foi criado em outubro de 2015 para facilitar o recolhimento. Mas as duas tiveram uma surpresa quando Ana foi a uma agência do INSS pedir o auxílio-doença.

“Levei tudo, carteira de identidade, carteira de trabalho e todos os comprovantes do pagamento do INSS e não conseguiam, não me achavam no sistema”, contou a babá Ana Maria Santos.

“Um susto enorme porque tudo pago e acho que ela também se assustou porque ela pensou: nossa, imagina, se ela não está pagando, ninguém está”, disse a juíza do Trabalho Luciana Rocha.

O funcionário da agência disse que o nome dela tinha que constar na guia de recolhimento, mas hoje esse documento só tem campo para o nome do patrão.

A gente vai acompanhar a Ana nesta segunda tentativa de receber o auxílio-doença. Desta vez, ela trouxe, além da carteira de trabalho e da guia de arrecadação do e-social, todos os recibos de pagamento de salário. Vamos ver se agora ela consegue.

Na agência, depois de quatro horas de espera, ela foi atendida e mostrou todos os documentos. Sem saber que estava sendo gravado, o funcionário disse que o sistema da Receita ainda não tem interligação com o INSS.

Mesmo que o dinheiro do patrão seja arrecadado, as informações do beneficiário não chegam à agência. A solução? Fazer tudo manualmente.

“Estou pondo na marra, quer dizer, o sistema continua não se comunicando. Não tenho uma previsão de quanto tempo vou demorar para fazer isso”, disse o funcionário.

Muitos trabalhadores domésticos têm enfrentado o mesmo problema. Por isso o Instituto Doméstica Legal entrou nesta segunda-feira (6) com uma representação no Ministério Público Federal contra o governo.

“O sistema, como é social, há 15 meses não está integrado com o sistema da Previdência, isso daí eu chamo de falta de respeito com milhões de trabalhadores e empregadores, domésticas, na minha avaliação é uma falta de querer fazer”, disse Mário Avelino, presidente do instituto.
O secretário da Receita Federal, Jorge Rachid, disse que não tem uma data para a integração de dados porque depende do INSS.

“Essa informação não é gerida pela Receita Federal, é gerida pelo próprio INSS. O e-social, que é um programa compartilhado, está rodando, a base está disponível. A informação que eu tenho é que já está muito próximo essa comunicação entre a base do e-social e os sistemas do INSS”, disse Jorge Rachid.

“Eu quero o que tenho direito, é meu direito. Se eu pago, eu quero receber”, diz a babá Ana.

O INSS declarou que a Dataprev deve apresentar uma solução para a falta de integração nas próximas semanas. A Dataprev alega que o processo é complexo. Sobre situações como a da Ana, o INSS afirmou que mantém contato com as superintendências regionais pra dar atenção aos casos em que há atraso na concessão dos auxílios.
